As far as i know 16 nost team members (GMs mostly) merged with the elysium team. So, mostly yeah. The actual Nost Coders/devs said that they are not involved, and never will be.

The original nost shut down after a warning/threat, there was no legal action taken. About the putting together a legal team to kill nost, yes it is possible, however it costs time, money, and effort. The only thing blizzard can do is to just let it be, and send letters every so often.
