Character/Currency/Item restoration of our ToU. There are no specific section in regards to Guild restoration, however it is considered an "Item". Also there's a lack of evidence to support your claim, we can not remove the standing Guild Leader and hand you the rank. This will violate this section of our ToU: IV. Misloots Elysium staff does not handle requests for reassignment of loot from one player to another when the item was accidentally awarded to the wrong player.
