As far as I know and I may have some of this wrong / read the wrong information lots of private servers get cease and desist letters. Nostalrius willingly shut their server down although living in France if blizzard did decide to pursue further legal action they could be taken  to court. Elysium has said they will ignore any cease and desist letters they receive. Supposedly they live in Russia or so I've read and copyright law doesn't mean фекал to Russia. If their host is forced to take down the server they will just pick another and rehost the data base.

Actually the Elysium server is in the location the Nos server was. Blizzard would have to take them to court. I don't think this will ever happen. The фекал storm it would cause could villainess blizzard more than the first shutdown did.

Well, that's the fun part for me. So the russians are in command now. So they can ingore blizzard. But they decided to host their servers at OVH (the same place where Nost was). And OVH can't ignore blizzard. Yeah, they can move to another host any time, but what is the point to use already compromised host? Correct me if I'm wrong but this feels like a plain stupidity.

They basically said that their response to any C&D order from blizzard would be something along the lines of....

It can be a good chance for Bilzzard to shutdown the server just to show where is the power.

most of the time they don't but Elysium is a big community.

sojs123 yes you can ignore that piece of paper but that is just a warning they tell you shut down the server or see you in court. Blizzard is just trying to scare you but if they really want is not hard to sue Nost/Elysium.

If they do ever shut it down, they could just relaunch it again. 

And again. 

And again. 

 

We're a lot more stubborn than Blizzard is. I'd rather play for a year at a time with a couple month break than play retail right now. Tell them to stop putting out shitty expansions and maybe people will want to play their game.

Agree. Nost's devs just tried to be good guys in Blizzard's eyes.

 

Even if they shutdown Elysium (which is highly improbable) the project will reborn again by someone else.

My thoughts on this are why would the Elysium team put fourth all this effort to bring the servers back if they are just gonna roll over when Blizzard comes knocking? Also I do not believe Blizzard will push to hard to shut Elysium down because of bad PR, we all know how bad it made them look the first time.
